Magnetik Media provides digital marketing, social media management, content creation, branding, videography, and related services. Specific deliverables are outlined in proposals, invoices, or contracts.

2. Payments & Cancellations

All invoices are sent via Chase Invoicing.

Payments must be made according to invoice terms.

Deposits are non-refundable, unless otherwise agreed in writing.

Late or missed payments may result in paused or terminated services.

We are not responsible for payment delays or errors caused by Chase.

No refunds are issued for completed services or active subscriptions.

Subscription services require 30 days' written notice for cancellation.

Billing is determined per-project or on a subscription basis, as agreed.

3. Client Responsibilities

Users of our services may be asked to provide information, access, or resources necessary to complete their requested work.

Provide accurate and timely information, feedback, and brand assets.This can include (but isn’t limited to) relevant account access, documentation, or other materials required to deliver the agreed-upon services. Timely cooperation helps ensure smooth setup and performance.

Ensure any materials you provide comply with applicable advertising laws.

Acknowledge that results (e.g., sales, leads) cannot be guaranteed.

4. Intellectual Property

All creative work remains the property of Magnetik Media until full payment is received.

After full payment, rights to final deliverables transfer to the client (unless stated otherwise).

We reserve the right to display completed projects in our portfolio or marketing.

In addition, we may use proprietary systems, tools, or frameworks as part of delivering your solution. These components are non-transferable and may not be resold, re-licensed, or redistributed by you. 

Any proprietary tools, templates, or automations developed during your project may also be reused by us in future work, unless otherwise agreed in writing.

For subscription-based services, these systems remain the property of The Digital Donkey. For custom projects, you’ll have full access to use and modify the delivered solution for your internal business purposes.

Additionally, permission is granted to temporarily download one copy of the materials (information or software) on this website for personal, non-commercial, and transitory viewing only. This is the grant of a license, not a transfer of title. Under this license, you may not:

i. Modify or copy the materials

ii. Use the materials for any commercial purpose or public display (commercial or non-commercial)

iii. Attempt to decompile or reverse engineer any software contained on the website

iv. Remove any copyright or proprietary notations from the materials

v. Transfer the materials to another person or "mirror" them on any other server

This license shall automatically terminate if you violate any of these restrictions and may be terminated by The Digital Donkey at any time. Upon termination, you must destroy any downloaded materials in your possession, whether in electronic or printed format.

5. Limitation of Liability

We are not liable for indirect, incidental, or consequential damages from the use of our services.

We are not responsible for changes in third-party platforms (e.g., Meta, Google) that affect results.

AI-generated errors or misinterpretations

We are not liable for failures or disruptions from third-party platforms, APIs, or service providers

We are not liable for client-side modifications that introduce bugs, reduce performance, or compromise security

In no event shall Magnetik Media (MGNTK Media) or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use our services or the materials on this website, even if we or an authorized representative has been notified orally or in writing of the possibility of such damage.

Some jurisdictions do not allow limitations on implied warranties or the exclusion of liability for incidental or consequential damages, so these limitations may not apply to you.

We are not responsible for outages, policy changes, or actions by these providers.

Support is provided Tuesday–Thursday from 10:00 AM to 5:00 PM EST excluding holidays, via email or our support desk.

Either party may terminate the agreement with written notice.

Client remains responsible for all payments owed up to termination.

Client remains responsible for payments of all completed work.

11. Governing Law

These Terms are governed by the laws of the State of Georgia, USA (or your registered state).

12. Updates

We may revise these Terms from time to time. Continued use of our services means you accept the updated Terms.
